II. Data processing when visiting our website and using the web app

1. Cookies, general

We use cookies on our website. Cookies are small (text) files that are created and stored on your end device (e.g. smartphone, notebook, tablet, PC). Most cookies are so-called „session cookies“ which are deleted at the end of the visit. In individual cases, however, these cookies provide information to automatically recognize the user. 2. Data security

When you visit this website, the SSL procedure (Secure Socket Layer) is used in conjunction with the highest level of encryption supported by the browser you are using. This is usually 256 bit encryption. If the browser you are using does not support 256-bit encryption, 128-bit v3 technology is used. We use web fonts provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA („Google“). The service is designed to provide a consistent and accurate representation of fonts on our site. To do this, your browser connects to Google’s servers and loads the required web fonts into your browser cache as soon as you call up a page on our website. In the process, Google learns that our website has been accessed via your IP address.

The legal basis for the use of Google Web Fonts is Art. 6 para. 1 lit. f GDPR (legitimate interest). Our legitimate interest is the uniform and correct presentation of the fonts on our website.

4. Establishing contact

You have the opportunity to contact us via various means of communication such as e-mail or mail. If you contact us, we will save your data for the purpose of processing your enquiry. The data will not be passed on to third parties. Personal data will be processed in accordance with Art. 6 Para. 1 S. 1 lit. f GDPR. The legitimate interest here is in the processing of your request. If the purpose of your contact is to conclude a contract, the legal basis is Art. 6 Para. 1 S. 1 lit. b GDPR. We will delete this data as soon as your enquiry has been conclusively clarified and provided that there are no legal storage obligations to the contrary.

5. Registration function

You have the possibility to register via our web app. If personal data is collected during registration (e.g. name, e-mail address), this will be used exclusively for the use of the web app and our services.
The following data in particular are collected during registration:

If you register as a natural person and consumer:

– First and last name

When you register a company:

– Name and address of company, region and country

– E-mail address

– commercial register number

– Information on the legal representative (name and address, date of birth, nationality and country of origin)

When you register an organization:

– Name and address of the organization, region, and country.

– E-mail address

– Information on the legal representative (name and address, date of birth, nationality and country of origin)

When you register a sole proprietorship:

– Name and address of the entrepreneur, region, and country.

– E-mail address

– Information on the legal representative (name and address, date of birth, nationality and country of origin)

The processing of the data entered during registration is carried out for the execution of the contract concluded with you. The legal basis for data processing in this case is (Art. 6 Para. 1 lit. b GDPR).

If you register via our web app, the data provided during registration will be forwarded directly to MANGOPAY SA, 2 Avenue Amélie, L-1125 Luxembourg. MANGOPAY will use this data to create a virtual account for you as a user.

Sign in with Twitch:

You can register with us using your Twitch account. Provider of this service is Twitch Interactive Inc., 350 Bush Street San Francisco, CA 94104.

If you register via Twitch, you will automatically be forwarded to the Twitch platform, where you can log in with your usage data. If you register via this service, Twitch will link your profile to our service. In doing so, we get access to your data stored at Google. These are above all:
– username,
– the origin of the connection from/to the Twitch services
– other relevant usage and diagnostic data

We use them to set up, deploy and personalize your account.

The legal basis for the processing is Art. 6 para. 1 lit. f DSGVO. We have a legitimate interest in providing you with convenient access to our services.

In this case, Twitch can establish a link between your account and your registration with us. For further information, please refer to the Google Terms of Use and Twitch’s Privacy Policy.

Sign in with Google:

You can register with us with the help of Google Sign In.The provider of this service is Google Ireland Limited, registered and operated under Irish law (registration number: 368047), Gordon House, Barrow Street, Dublin 4, Ireland.

Registration via Google Sign In is done by clicking on the „Login with Google“ / „Connect with Google“ button. In this case you will be automatically redirected to the Google platform where you can log in with your usage data. If you register via this service, Google will link your profile to our service. In doing so, we get access to your data stored at Google. These are above all:
– Google name
– Google profile picture
– email address registered with Google

We use them to set up, deploy and personalize your account.

The legal basis for the processing is Art. 6 para. 1 lit. f DSGVO. We have a legitimate interest in providing you with convenient access to our services.

6. Web analysis

We use web tracking and web analysis services. These are services that allow us to analyse the use of our website. We use this data to improve the website and to make our services more interesting for you. The legal basis for the use of web analysis tools is Art. 6 Para. 1 S. 1 lit. f GDPR. We have a legitimate interest in analysing the user behaviour of our website in order to optimise both our offer and our advertising.

Google Analytics (with anonymization function)

This website uses Google Analytics, a web analysis service of Google Inc. („Google“), Google Analytics component is Google Inc, 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA. Google Analytics uses so-called „cookies“. These are text files that are stored on the user’s computer and enable an analysis of the user’s use of the website. The information generated by the cookie about the use of this website (including the IP address) is transferred to a Google server in the USA and stored there. Your IP address is further processed in an anonymised form using the _anonymizeIp() method if access to this website is from a member state of the European Union or another state party to the Agreement on the European Economic Area. A personal reference can thus be excluded. As far as the collected data of the user is related to a person, this is immediately excluded. The personal data will be deleted immediately.

The legal basis for the processing is Art. 6 para. 1 lit. a DSGVO. The processing is carried out exclusively on the basis of the consent given by you. This consent is voluntary and can be revoked by you at any time for the future by simply notifying us. The revocation of consent for the future does not affect the lawfulness of the processing until revocation.

Google AdWords / Google Remarketing

We use the Google Remarketing service. Google Remarketing is a feature of Google AdWords and is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043-1351, USA. The remarketing service allows us to provide the user with targeted and user-centric advertising via the Google advertising network or other internet sites if the user has previously visited our website. The purpose of Google Remarketing is to display interest-based advertisements that are tailored to the individual needs and interests of users. The legal basis for the processing is Art. 6 Para. 1 lit. f GDPR. Google Remarketing places a cookie on your device (e.g. PC, laptop, smartphone). The cookie enables Google to recognise the user when he or she calls up another website after visiting our website that is also a member of the Google advertising network. Your internet browser automatically identifies itself to Google each time you visit a website that incorporates the Google Remarketing service. Google obtains knowledge of various personal data (e.g. IP address). Google uses this data to display advertisements relevant to your interests. Every time the user visits our website, personal data is transmitted to and stored by Google in the USA. Google reCAPTCHA

We use the reCAPTCHA feature of Google LLC, 1600 Amphitheater Parkway, Mountain View, CA 94043, USA („Google“). The feature allows us to distinguish whether an entry on our website is made by a natural person or by automated, automated input, such as a bot. This is to prevent spamming. When using the reCAPTCHA function, the IP address and possibly other data required by Google will be transmitted to Google. The legal basis for use is Art. 6 para. 1 lit. f DSGVO. 7. Saving of IP addresses

We save your IP address for a period of 3 months. The storage is done for the prevention and follow-up of crimes.The storage serves for the prevention and follow-up of crimes. The data will not be passed on to third parties, unless we are obliged to do so by law or binding order. The legal basis for storage is Art. 6 Para. 1 Sentence 1 lit f) DSGVO. We have a legitimate interest in protecting ourselves and our customers from criminal offences and in investigating such offences.

III. Data processing when using our services

When using our services, in particular for sending and receiving payments, we process a number of personal data.

What data do we process and for what purpose?

We process the user’s personal data primarily to process the payments he or she sends and receives and to protect us from misuse. Data processing takes place for the purpose of

  • Execution and settlement of payments sent and received by the user
  • Prevention and prosecution of criminal offences
  • For identification of the user in the respective social network and allocation of payments
  • To identify the user in our Know Your Customer process

The identification of the user in the respective social network and in the Know-Your-Costumer process is necessary in order to be able to execute the payment order and, if necessary, to prevent or prosecute abuse or criminal offences.

For the registration and execution of the payment order, we need to process a number of personal data. We process in particular:

  • Data of the user and payee and account holder (such as name, address, contact data, date of birth, gender)
  • Social network data (user name, content of the post, link to the post, reference ID of the recipient in the social network)
  • Account, bank and credit card data (e.g. IBAN, MANGOPAY reference ID, payee, cardholder reference ID)
  • Transaction data of the payment (name of the payee and name of the donor, ID in the respective social network)
  • Know Your Customer Data (KYC) (type of proof of identity, modification date, user reference ID).

For legal reasons to combat money laundering and terrorist financing, we are obliged in particular to collect the following data and pass them on to MANGOPAY SA, 2 Avenue Amélie, L-1125 Luxembourg:

If you use the service as a natural person and consumer:

  • Name, first name, e-mail address, date and place of birth, nationality and country of residence.
  • Copy of a valid official identity document of the holder (e.g. identity card, driving licence and, for third-country nationals in the European Union, a passport).

If you use the service commercially as a natural person:

  • Name, first name, e-mail address, date and nationality of birth and country of residence.
  • Original or copy of an extract from the Official Journal, no more than three months old, certifying registration as a trader or in the national trade register or any other professional body on which the holder depends.
  • Copy of a valid official identity document of the holder (e.g. identity card, driving licence and, for third-country nationals in the European Union, a passport).

If you use the service as a legal entity:

  • Company name, type of company, address of registered office, identity of partners and managing directors and list of authorised users as defined by the Regulation,
  • Commercial register extract or equivalent document not more than three months old which justifies entry in the commercial register of a Member State of the European Union or of a State of the European Economic Area or of a third country which imposes equivalent obligations with regard to combating money laundering and terrorist financing. This document must certify the company name, the legal form, the address of the registered office and the identity of the partners and directors mentioned under 1° and 2° of article R.123-54 of the Commercial Code or their equivalents in foreign law.
  • Certified copy of the statutes and any resolutions appointing the legal representative;
  • Copy of the identity card or passport of the legal representative and, if applicable, of the authorised user(s).
  • The declaration of the legal entity’s authorised users holding more than 25% if the interested party has not registered its authorised users in the national register or is not subject to this obligation.

The transfer to MANGOPAY is necessary in order to process the respective payment and to uniquely identify the respective user. The transfer also takes place to combat money laundering and terrorist financing. The legal basis for the transfer of data is Art. 6 Para. 1 Sentence 1 lit. b and c GDPR. Data will only be processed for purposes other than those mentioned above if you have given your consent. Such consent is voluntary and can be revoked by you at any time. A simple notification to us is sufficient to revoke your consent. The revocation of your consent does not affect the legality of the data processing until the time of revocation.

To whom do we pass on your data?

In order to process the payment and to improve and further develop our services, your data may be transferred to the following third parties:

  • AWS a service of Amazon Web Services, Inc., P.O. Box 81226, Seattle, WA 98108-1226, USA
  • Google Firebase, a service Google Ireland Limited (registration number: 368047) established at Gordon House, Barrow Street, Dublin 4, Ireland

AWS and Google Firebase are used as servers on which the data is stored. The data is stored encrypted at AWS and Google Firebase, so that neither AWS nor Google Firebase can view this data.  The legal basis for the processing is Art. 6 para. 1 sentence 1 lit. b GDPR.

The processing of your data takes place exclusively within the territory of the European Union. The servers on which the data processing takes place are located at the following locations:

  • AWS: Germany
  • Google Firebase: Ireland
  • MANGOPAY: Luxembourg

Storage of your data

We keep your personal data for the time you have an account with us. You can delete the data from your user account yourself. After the deletion these data are also deleted in our system.

MANGOPAY generally retains your personal data for up to 5 years after the end of the contract. Further information on data processing by MANGOPAY can be found in MANGOPAY’s data protection information.

Legal basis for the processing

The legal basis for the processing of your data to process payment is Art. 6 Para. 1 lit. b GDPR. Data processing is necessary in order to execute the existing contract with you.

In addition, we have a legitimate interest in protecting ourselves and our users from criminal acts. Within this framework, we process your data on the basis of Art. 6 Para. 1 lit. f GDPR.
